These Terms of Service (“ToS”) govern the use of the sagastories.app website and the Saga Stories mobile application (hereinafter “the Service”) and define the terms and conditions of access and use of the Service by “the User”.

Article 1: Purpose and Access to the Service

The Service offers a storytelling experience based on mythology. Access to the Service is free for its basic features. Certain features or content may be available for a fee through subscriptions or in-app purchases processed exclusively through Apple’s App Store.

The User acknowledges that this agreement is concluded between the User and MRM Labs only, and not with Apple Inc. Apple is not responsible for the Service or its content. MRM Labs, and not Apple, is solely responsible for the Service and the content thereof.

Article 2: Registration and Access
Access to certain features of the application requires authentication via an Apple ID (“Sign in with Apple”).

Article 3: Intellectual Property

All content of the Service (texts, audio narrations, images, logos, source code, design) is the exclusive property of MRM Labs – Mehdi Rerhrhaye EI.

Any reproduction, distribution, modification, adaptation, retransmission, or publication, even partial, of these elements is strictly prohibited without the express written consent of MRM Labs. Failure to comply with this prohibition constitutes an infringement that may result in civil and criminal liability for the infringer.

Article 4: User’s Obligations
The User agrees to use the Service fairly and in compliance with these ToS. The User is specifically prohibited from:
* Copying, selling, distributing, or commercially exploiting the content of the Service.
* Engaging in “reverse engineering”, decompiling, or disassembling the application.
* Using the Service for illicit, illegal, or immoral purposes.
* Disrupting or attempting to disrupt the proper functioning of the Service.

Article 5: Purchases and Subscriptions
The Service offers auto-renewable subscriptions giving access to premium content and features. The following terms apply:

• Subscription title: Two available options “Saga monthly subscription” or “Saga annual subscription “
• Duration:  “Saga monthly subscription” granting access for 1 month. “Saga annual subscription ” granting access for 1 year
• Price: The price will be clearly displayed in the app prior to any purchase, in the User’s local currency.
• Payment: Payment will be charged to the User’s Apple ID account upon confirmation of purchase.
• Auto-renewal: The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. The account will be charged for renewal within 24 hours prior to the end of the current period at the same price, unless otherwise indicated.
• Managing the subscription: The User can manage and cancel their subscription at any time by going to their App Store account settings after purchase. Cancellations take effect at the end of the current paid period.
• Free trial (if applicable): Any unused portion of a free trial period will be forfeited when the User purchases a subscription.

Article 6: Limitation of Liability
The Service is provided “as is” and is accessible based on its availability. MRM Labs shall not be held liable for any inability to access the Service.
MRM Labs strives to provide quality content but does not guarantee that the Service will be free of errors, bugs, or interruptions.
In no event shall MRM Labs be liable for indirect damages (such as loss of data, loss of profit, etc.) resulting from the use of the Service.

In the event of any failure of the application to conform to any applicable warranty, the User may notify Apple, and Apple will refund the purchase price (if any) for the application to the User. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the application. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of MRM Labs.

Article 7: Sanctions for Breach
In the event of a violation of one or more provisions of these ToS, MRM Labs reserves the right, without prior notice, to temporarily suspend or permanently terminate the User’s access to the Service.

Article 8: Personal Data
The collection and processing of the User’s personal data are governed by our Privacy Policy, which is an integral part of these ToS.

Article 9: Governing Law and Jurisdiction
These ToS are subject to French law. In the event of a dispute and in the absence of an amicable agreement, jurisdiction is attributed to the competent courts within the jurisdiction of the Commercial Court of Paris.

Article 10: Changes to the ToS
MRM Labs reserves the right to modify the terms of these ToS at any time. 

Article 11: Apple-Specific Terms

The User acknowledges and agrees to the following terms specifically applicable to the use of the Saga Stories mobile application on Apple devices:

11.1 Acknowledgment These Terms of Service are concluded between the User and MRM Labs only, and not with Apple Inc. (“Apple”). MRM Labs, not Apple, is solely responsible for the Saga Stories application and its content. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the application.

11.2 Scope of License The license granted to the User for the application is a limited, non-transferable license to use the application on any Apple-branded products that the User owns or controls, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the application may also be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.

11.3 Maintenance and Support MRM Labs is solely responsible for providing any maintenance and support services with respect to the application, as specified in these Terms or as required under applicable law. The User acknowledges that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the application.

11.4 Warranty MRM Labs is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the application to conform to any applicable warranty, the User may notify Apple, and Apple will refund the purchase price for the application to the User (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be the sole responsibility of MRM Labs.

11.5 Product Claims MRM Labs, not Apple, is responsible for addressing any User or third-party claims relating to the application or the User’s possession and/or use of the application, including but not limited to: (i) product liability claims; (ii) any claim that the application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the application’s use of the HealthKit and HomeKit frameworks (if applicable).

11.6 Intellectual Property Rights The User acknowledges that, in the event of any third-party claim that the application or the User’s possession and use of that application infringes that third party’s intellectual property rights, MRM Labs, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

11.7 Legal Compliance The User represents and warrants that (i) they are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) they are not listed on any U.S. Government list of prohibited or restricted parties.

11.9 Third Party Terms of Agreement The User must comply with applicable third-party terms of agreement when using the application.

11.10 Third Party Beneficiary The User and MRM Labs acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms of Service, and that, upon the User’s acceptance of these Terms of Service, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms of Service against the User as a third-party beneficiary thereof.
